Josh Bernstein represents employees from every walk of life. Josh litigates cases in federal and state courts, in employment discrimination proceedings before the U.S. Equal Employment Opportunity Commission, the New York State Division of Human Rights, the New York City Commission on Human Rights, and in private forums such as arbitration. He represents clients with a wide variety of claims, including discrimination, sexual harassment, severance disputes, and wage-and-hour suits. While other firms use a “volume” business model, Josh Bernstein only takes cases he believes will survive the various hurdles of the legal process, and plans on taking each and every case to trial. He only settles when it is in your interest.
Josh also advises employees on employment contracts and offers, severance and departure agreements, and the applicability of restrictions in employment agreements such as non-compete and non-solicitation clauses. He represents management in non-adversarial contexts such as the creation and maintenance of anti-discrimination policies and contract negotiations. He occasionally represents management when he believes the case has absolutely no merit.
